Terms of Use for the Job Board

GesBiT Non-profit Society for Education and Participation (GesBiT) fulfills a public mandate through JOB POINT Berlin, providing services in the field of labor market integration for both citizens and businesses. For this purpose, three stores with customer-friendly opening hours are available in Berlin, as well as the website www.jobpoint-berlin.de. For reasons of simplification and better clarity, references to individuals are made in the masculine form below, but all genders are addressed. The following regulations apply to the use of JOB POINT Berlin’s services:

§1 Eligibility for Use (1) All services provided by JOB POINT Berlin are freely accessible and free of charge for any legally competent natural or legal person, subject to the terms of use. There is no right to claim the services. (2) By accepting or submitting an offer, the user gives their explicit consent for JOB POINT Berlin to store and process the user's data for the purpose of providing the agreed service.

§2 Copyright (1) Users grant JOB POINT Berlin, as well as all other users of JOB POINT Berlin and linked internet job boards, the simple, geographically and temporally unlimited right to use the posted job offers for the purpose of employment and training mediation. The copyright for the JOB POINT database and its contents lies entirely with JOB POINT Berlin. (2) By submitting a job offer, the user explicitly consents to the storage, processing, and use of their data exclusively for the purposes of JOB POINT Berlin. (3) The website contains data and information of all kinds, which are protected by copyright. Therefore, it is not permitted to download, reproduce, or distribute this data for anything other than personal use, except for the job offers. (4) The use of JOB POINT Berlin’s data for advertising purposes is expressly prohibited according to §§28,29 of the Federal Data Protection Act (BDSG).

§3 Liability (1) The user who posted the offers and events published on JOB POINT Berlin, or the user on whose behalf they were posted, assumes exclusive responsibility for them. JOB POINT Berlin is not liable for the content published by companies. Employers are responsible for ensuring compliance with legal regulations in the published content. (2) Our site contains links to external websites of third parties, whose content we have no influence over. Therefore, we cannot assume any liability for the content of external sites. The provider or operator of the linked pages is always responsible for their content. If we become aware of legal violations, we will remove such links immediately. (3) Downloads are at the user's own risk. We assume no liability for damages caused by downloading, installing, storing, or using software or content from our website, unless we are at fault. Although we use current virus scanning programs, we assume no liability for damages or malfunctions caused by viruses or so-called worms.

§4 Use (1) The use of the job portal is free of charge and accessible to every user, subject to these terms of use. JOB POINT Berlin reserves the right to exclude companies from posting jobs or from using the portal entirely without providing reasons. (2) JOB POINT Berlin is not liable if another job portal copies the published job offers and posts them on their own platform. (3) Offers that violate legal regulations or public morals will not be posted. JOB POINT Berlin reserves the right to remove such offers after appropriate review.

§5 Registration (1) Registration as a user is required to use the job portal. Registration is free of charge. When registering, please provide the company for which you wish to post jobs. If possible, employees of JOB POINT Berlin will create the company for you based on the online presence. Multiple users can manage a company. (2) Each email address may only be used once for registration. If you forget your password, you can reset it by selecting “Forgot Password” and creating a new one. (3) By registering, you agree to the linked privacy policy and the terms of use of the job portal. (4) After successful registration, both approval by JOB POINT Berlin staff and email address verification are required. After registration, you will receive an email for email verification, which can be done by clicking the link.

§6 Completing Your Company Profile (1) Please review all company details under the “Company” section and correct them if necessary. (2) Set up contacts for the company's job advertisements for applicants. (3) Please upload a logo to increase the visibility of your job advertisements on our website. The logo file must be a .jpg or .png file with a maximum size of 4096 KB.

§7 Publication of Job Offers (1) There is no right to have job offers posted. (2) The maximum publication period is 8 weeks. If the job offer includes an application deadline, that deadline is the publication period. (3) Job offers will be posted on-site and are available online on our website: www.jobpoint-berlin.de/job-boerse. The placement of posted job offers will be determined individually by each of the three JOB POINT Berlin locations. If space is no longer available at a location, JOB POINT Berlin reserves the right to make a selection and only publish some job offers online. (4) Job offers can be created via the “Jobs” menu. Mandatory fields are marked with an asterisk. (5) Each vacancy may only be posted once. A second offer for the same job will not be published.

§8 Formalities to Be Observed (1) Please use the provided bullet points for correctly displaying lists. (2) There is no character limit for the online version of the job offer. In the paper version, it will be shortened to A4 size, and the sentence will appear: “This content is fully displayed in the online version but is shortened for the PDF printout.” The printout will show: “…more info online” with the corresponding link. (3) When formulating the job offer, applicable legal regulations, such as the General Equal Treatment Act (AGG), must be observed.

§9 Management of Job Offers (1) Each job offer must be approved by JOB POINT Berlin staff before publication. Staff has the right to make minor changes to the job offers regarding spelling, grammar, and formatting. Substantive changes will only be made in consultation with the company’s contact person. (2) Job offers will be deactivated after the publication/application deadline. (3) Filled positions can be re-published within 2 weeks via the dashboard or later through “inactive jobs” if further personnel is needed. (4) You can make changes to your profile independently. Afterward, approval by JOB POINT Berlin staff is required for the change to become visible.

§10 Categories Each job will be classified into a job category. JOB POINT Berlin staff is authorized to modify these classifications if this seems appropriate.

§11 Job Description The job description must comply with the AGG. The employer is responsible for this.

§12 Contact Information for Applicants and JOB POINT Berlin Staff All required details for the application must be provided. Please note that you have the option to provide different contact details for applicants and JOB POINT Berlin staff.

§13 Workplace (1) The workplace must be located in Berlin or Brandenburg within the postal code range 10115-16999. (2) Please specify the postal code of the workplace in the job offer. If this is not possible, specify the district or “Berlin-wide.”

§14 Private Employment Agencies The posting of job offers by private employment agencies is not permitted.

§15 Registration for Trade Fairs and Events The registered user can request a booth at trade fairs and events for the registered company by submitting a “company inquiry.” The offer submitted by the company is only accepted when JOB POINT Berlin sends the participation confirmation.

§16 Warranty JOB POINT Berlin only provides users with access to job offers and does not warrant the accuracy of the information in the job postings.

§17 Severability Clause If one of the above provisions is invalid, the remaining provisions shall remain unaffected and continue to be valid. Subsidiary agreements and amendments must be made in writing.
